Terms of Service

1. About These Terms

These Terms of Service ("Terms") govern your access to and use of Postelio, including its website, application, content-generation features, publishing tools, automations, integrations, and related services (collectively, the "Service").

Postelio is operated by Dmitry Rannev, trading as Postelio, established in Spain ("Postelio", "we", "us", or "our").

When you create an account, you are asked to confirm that you agree to these Terms. By confirming, or by otherwise using the Service, you agree to these Terms. We record which version of these Terms you accepted and the date on which you accepted it.

If you use Postelio on behalf of a company, organization, or other person, you represent that you have authority to accept these Terms on their behalf.

If you do not agree to these Terms, you must not use the Service.

2. Eligibility and Accounts

You must have the legal capacity required under applicable law to enter into these Terms.

You must provide accurate information when creating and maintaining your account.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity performed through your account, except to the extent that such activity results from circumstances for which Postelio is legally responsible.

You must notify us promptly if you become aware of unauthorized access to or use of your account.

You may not use another person's account without authorization or create accounts using false or misleading identities.

3. The Postelio Service

Postelio provides tools for creating, adapting, organizing, scheduling, automating, and publishing content.

Depending on the features available under your plan and configuration, the Service may allow you to:

  • generate content using artificial intelligence;
  • generate or process images and media;
  • create content in multiple languages;
  • adapt content for different social networks and platforms;
  • connect external AI providers;
  • connect social networks and communication platforms;
  • schedule publications;
  • create campaigns and publishing automations; and
  • automatically generate and publish content according to rules and settings you configure.

Features may vary depending on your plan, account configuration, connected providers, technical availability, and changes to the Service.

4. Workspaces and Account Administration

Postelio may organize users, content, integrations, and other resources within customers, workspaces, or similar account structures.

Workspace owners and authorized users may be able to invite or remove members and assign permissions or roles.

If you grant another person access to your workspace or account resources, you are responsible for ensuring that they are authorized to receive that access.

Organizations using Postelio are responsible for managing their own users and permissions appropriately.

Certain limits, allowances, or subscriptions may apply at the customer or account level and may therefore be shared across multiple workspaces or users.

5. AI-Generated Content

Postelio may generate, modify, translate, or adapt content using artificial intelligence.

AI-generated content may be inaccurate, incomplete, misleading, inappropriate, or otherwise unsuitable for its intended purpose. Postelio does not guarantee the accuracy, legality, originality, or suitability of AI-generated content.

You are responsible for determining whether content generated through Postelio is appropriate for your intended use and complies with applicable laws, third-party rights, and the rules of the platforms where it is published.

Postelio may allow you to configure content to be published automatically without prior manual review.

If you enable automatic publishing, you authorize Postelio to publish generated content on your behalf without requiring your prior approval of each individual publication. You remain responsible for choosing to use this mode and for the content published through your configured automations.

You should configure your prompts, campaigns, publishing rules, connected channels, and automation settings appropriately for your intended use.

6. Postelio AI and Bring Your Own AI

Postelio may provide access to AI functionality through AI services configured by Postelio ("Postelio AI").

Postelio may also allow you to connect supported AI providers using your own credentials or API keys ("Bring Your Own AI" or "BYO AI").

When using BYO AI, your relationship with the external AI provider remains subject to that provider's own terms, policies, pricing, quotas, and technical restrictions.

You are responsible for ensuring that you are authorized to use credentials you connect to Postelio and that your use complies with the relevant provider's terms.

External AI providers may change models, APIs, pricing, limits, availability, or functionality independently of Postelio.

Postelio does not guarantee continued availability of any particular third-party AI model or provider.

Where reasonably possible, Postelio may modify supported models, providers, or integrations in response to such external changes.

7. Connected Platforms

Postelio may allow you to connect supported social networks, communication platforms, and other external services.

You authorize Postelio to perform the operations you request or configure through those connections, including publishing content on your behalf.

You are responsible for ensuring that:

  • you are authorized to connect the relevant account or channel;
  • your use of the connected platform complies with its terms and policies;
  • content you publish is permitted on that platform; and
  • your configuration does not cause unauthorized or unlawful publishing.

Connected platforms are independent third-party services.

Their availability, APIs, authorization mechanisms, content rules, rate limits, and other functionality may change without Postelio's control.

Postelio does not guarantee that any particular external platform or integration will remain available indefinitely.

8. Publishing, Scheduling, and Automation

Postelio may allow you to schedule publications and configure campaigns or automations that generate and publish content without requiring manual action for every publication.

By enabling such functionality, you instruct and authorize Postelio to execute the configured operations on your behalf according to the settings you provide.

This authorization may include generating content, selecting configured publishing targets, scheduling operations, and publishing content without separate confirmation for each individual action.

You are responsible for reviewing and configuring your automation settings appropriately, including topics, prompts, languages, schedules, publishing destinations, and connected services.

Scheduled times represent the time at which Postelio is intended to process or initiate an operation. They do not constitute a guarantee that an external platform will receive or publish content at an exact time.

Publishing or generation may be delayed, rejected, or prevented by circumstances including:

  • external API outages or failures;
  • rate limits;
  • expired or revoked authorization;
  • provider policy changes;
  • unavailable AI models;
  • external platform restrictions;
  • network or infrastructure failures;
  • invalid configuration; or
  • other circumstances outside Postelio's reasonable control.

Postelio may use retries or other recovery mechanisms where supported, but does not guarantee successful completion of every automated operation.

9. User Content and Permissions

"User Content" means content, prompts, topics, text, images, media, instructions, and other material that you submit, upload, configure, generate, or process through the Service.

As between you and Postelio, Postelio does not claim ownership of your User Content merely because it is submitted to, processed by, or generated through the Service, subject to applicable law and any rights or terms applicable to third-party services.

You grant Postelio a limited, non-exclusive right to host, store, reproduce, process, modify, transmit, and otherwise use User Content only as reasonably necessary to provide, secure, maintain, and operate the Service and perform the operations you request.

This includes transmitting relevant User Content to AI providers, connected platforms, infrastructure providers, or other services where necessary to perform requested functionality.

You represent that you have the rights, permissions, and lawful basis necessary to provide and use User Content through Postelio.

You remain responsible for User Content and for the consequences of publishing or otherwise using it.

10. Acceptable Use

You must not use Postelio to:

  • violate applicable law or regulations;
  • infringe intellectual property, privacy, publicity, or other rights of another person;
  • publish content that you are not legally authorized to publish;
  • distribute malware or other harmful code;
  • attempt unauthorized access to Postelio, other accounts, systems, or networks;
  • interfere with or disrupt the operation or security of the Service;
  • circumvent technical restrictions, quotas, access controls, or security measures;
  • misuse external services or credentials through Postelio;
  • impersonate another person or misrepresent your authority;
  • use the Service for fraud or other unlawful activity; or
  • use automation in a manner that violates the rules of a connected platform.

You are responsible for ensuring that your use of AI-generated content and automated publishing complies with applicable law and the rules of the services to which you publish.

We may take reasonable action to investigate or prevent suspected abuse, security threats, or unlawful use.

11. Plans, Features, and Usage Limits

Postelio may offer different plans with different features, usage allowances, resource capacities, or other limits.

These may include limits relating to:

  • publications;
  • AI text generations;
  • AI image generations;
  • workspaces;
  • connected channels;
  • storage;
  • campaigns;
  • automation;
  • Bring Your Own AI; and
  • Postelio-provided AI functionality.

The limits and features applicable to your account are those presented for your current plan or otherwise agreed with you.

Usage limits may apply across multiple users or workspaces belonging to the same customer account.

Postelio may introduce, modify, or discontinue plans or features over time.

Where a change materially affects an existing paid service, we will provide notice where required by applicable law or the applicable agreement.

12. Payments, Subscriptions, and Consumer Rights

Postelio does not currently process payments through an integrated payment processor.

If paid subscriptions or other paid services are offered, the applicable price, billing period, taxes where applicable, renewal conditions, usage limits, cancellation information, and other required purchase information will be presented before you enter into the relevant paid transaction.

Additional payment or subscription terms may apply to a paid plan where they are disclosed to you before purchase.

Nothing in these Terms excludes or limits any mandatory rights that you have under applicable consumer law.

If you are a consumer and applicable law gives you a right to withdraw from a distance contract, that right will apply subject to the conditions, time limits, and exceptions established by applicable law.

Where applicable, we may ask you to expressly request that a digital service begin during a statutory withdrawal period and to acknowledge any legal consequences of that request.

Any refund rights, charges for services supplied during a withdrawal period, or loss of a withdrawal right will be determined in accordance with applicable law and the information provided to you when entering into the relevant paid transaction.

These Terms do not impose a general "no refunds" rule.

13. Suspension and Termination

You may stop using Postelio at any time.

Where account-deletion functionality is available, you may use it according to the functionality provided. You may also contact us where necessary regarding account or personal-data requests.

We may suspend or restrict access to all or part of the Service where reasonably necessary, including in response to:

  • serious or repeated violations of these Terms;
  • unlawful or abusive activity;
  • security threats;
  • unauthorized access;
  • actions that materially threaten the Service or other users;
  • legal or regulatory requirements; or
  • non-payment of applicable fees where paid services are introduced.

Where appropriate and reasonably possible, we may provide notice or an opportunity to remedy a violation before termination or suspension.

Immediate action may be taken where reasonably necessary to address security, abuse, legal, or operational risks.

Termination or account closure does not necessarily result in immediate deletion of every record.

Certain information may remain for legitimate operational purposes, backups, dispute resolution, security, accounting, or compliance with legal obligations, as described in our Privacy Policy.

14. Third-Party Services

Postelio depends on and integrates with third-party services, which may include AI providers, social networks, communication platforms, hosting providers, cloud services, email services, and other infrastructure.

Third-party services are not controlled by Postelio and operate under their own terms, policies, technical systems, and availability commitments.

Postelio is not responsible for changes, outages, restrictions, account actions, or other acts or omissions of third-party services except to the extent that applicable law provides otherwise.

Your use of a third-party service through Postelio does not replace or modify your agreement with that third party.

Postelio may change, replace, suspend, or discontinue an integration where reasonably necessary because of changes to a third-party service, security concerns, legal requirements, technical incompatibility, or discontinuation of the relevant external service.

15. Intellectual Property

The Postelio software, website, user interface, design, branding, logos, documentation, and other materials provided by Postelio are protected by applicable intellectual-property laws.

Except for rights expressly granted under these Terms, Postelio and its licensors retain their respective rights in the Service.

These Terms do not transfer ownership of the Postelio software, brand, or other Postelio intellectual property to you.

You may not copy, modify, distribute, sell, lease, reverse engineer, or otherwise exploit protected parts of the Service except where expressly permitted by law or by Postelio.

User Content is addressed separately in Section 9.

16. Service Availability, Warranties, and Liability

We aim to provide a reliable service, but Postelio may occasionally be unavailable, interrupted, delayed, or affected by errors.

The Service depends in part on third-party infrastructure, AI providers, social networks, APIs, internet connectivity, and other systems outside our direct control.

To the extent permitted by applicable law, Postelio is provided without a guarantee that the Service will always be uninterrupted, error-free, or suitable for every particular purpose.

AI-generated content and automated operations require particular care because their output or execution may vary and may depend on external systems.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

In particular, nothing in these Terms limits mandatory rights or remedies available to consumers under applicable consumer law.

To the extent permitted by applicable law, Postelio will not be responsible for losses caused solely by:

  • unlawful or unauthorized User Content;
  • incorrect configuration by the user;
  • the user's decision to enable automatic publishing;
  • actions or restrictions imposed independently by connected third-party services;
  • unauthorized use of external credentials supplied by the user; or
  • events outside Postelio's reasonable control.

Where Postelio is legally responsible for loss or damage, any limitation of liability will apply only to the extent permitted by applicable law.

17. Governing Law and Consumers

These Terms are governed by the laws of Spain, without prejudice to mandatory legal protections that may apply to you under the law of your country of residence.

If you are a consumer, nothing in these Terms deprives you of mandatory consumer protections or jurisdiction rights that cannot lawfully be excluded by contract.

We do not require consumers to submit disputes exclusively to a court that would be unlawful or unfair under applicable consumer law.

18. Changes to These Terms

We may update these Terms to reflect changes to the Service, applicable law, security requirements, third-party services, or our business operations.

When we make changes, we will update the "Last updated" date.

Where a change materially affects an existing contractual relationship, we will provide additional notice where required by applicable law.

Changes will not retroactively remove mandatory rights that already apply to you.
